Prosecution
Within an investigation the role of the prosecution is to works with the police giving them advice regarding the case they are working on this is done after the preliminary investigation has taken place, they help within the follow up investigations helping the police to produce the correct reports to ensure all information given to the jury is correct and everything has been recorded. After the preliminary investigation the prosecution have the role of helping the police review the case and making a final decision on whether it is beneficial to take it to court or not. They also have a close contact with both the victim and suspect; they work with the suspect teaching them that it may be easier for them to admit to what they have done than take the case to court if the suspect has been able to admit their actions to the prosecution. They talk to the suspect about receiving an order of summary of punishment where no trial will take place If they impose a fine with the prosecutor. The prosecution helps produce a decision with the court by giving them a detailed description of what has taken place as well as how it has happened, they may also decide to justify the suspects actions by informing them why they may have occurred. The prosecution is seen in court and questions three different people; these being the suspect, the victim and the forensic analyst the prosecution helps give the right amount of detail to the jury to persuade them that the suspect is guilty. Depending on whether the suspect pleads guilty or not guilty depends on the case being taken to court there role can vary as they are not always to be seen in a court setting.
Role of the Prosecution within the Soham Murders
Within the case of the Soham Murders Ian pleaded not guilty as he believed there wasn't sufficient evidence although the prosecution knew there was. This was a high profiled case as it was shown on media/ all over the news there was instant updates given to people within the UK, the crown prosecution service was used within the Soham murders very early to help build a case even when having no suspect. This was the biggest case that both Cambridgeshire Constabulary and the crown prosecution service had seen; the role of the crown prosecution service within this case was to consolidate the families of Holly and Jessica. All information wasn't given to the judge and jury in the court of law only what the prosecution believed was necessary, it was stated in court by the prosecution that the evidence kept building up against Huntley throughout the investigation which showed he had a role in both the girls deaths. Photographs and excel charts where shown in court of the evidence there was as well as the results they gained through examination, the solicitor within the defence was Marion Bastin and although they didn't get exactly what they wanted Huntley and Carr were both jailed for their part. A prosecutors role will vary through different investigations as they will only be deemed necessary if the investigation is being presented in court, although in every other aspect the role of the prosecutors will be similar because the prosecutors responsibility is to convince the judge or jury that an individual played a part in the crime they are being charged with.
